    The importance of risk assessments

Every employer has a legal duty of care to ensure that the people working for them, whether temporarily, permanently, part time or full time, are kept safe. Failure to do this can lead to an accident occurring and a member of staff being injured. In turn, this may mean that a claim is made against an employer to obtain financial compensation. We’ll reveal more about this below, as well as the cost of lawyers in East Riding of Yorkshire.

While, of course, it is not possible to do this at all times and in all situations, it is vital that an employer can demonstrate that reasonable steps have been taken to minimise the risk of injury within the workplace. One of the best ways to demonstrate that such steps have been taken is to perform a Risk Assessment.

A Risk Assessment is used to concentrate on the potential risks and dangers that employees may be exposed to. It can highlight areas where additional safely precautions should be taken. For example, if lifting is a regular part of a job then there is a danger that someone may be injured as a result of a pulled muscle. To avoid this, an employer may agree that training should take place so that all staff members required to perform this task are well aware of the proper manual handling techniques. Perhaps specialist equipment could also be provided.

If such issues are highlighted in a Risk Assessment, and the appropriate steps are not taken, and a member of staff is injured as a result, then a claim can be made against the employer. It is important that anything highlighted in a Risk Assessment is appropriately dealt with.

    The importance of recordings

Equally, it is important to record the details of a Risk Assessment and all associated issues therein. Should an employer determine that additional training is required, it is important that they arrange for this training. If an employee receives this training and is provided with the necessary tools to do the job and is subsequently injured, it may be possible to refute any claim made. This is because the injury may have been caused as a result of something the employee did that they shouldn’t have been.
