East Dunbartonshire No Win No Fee

There are many assumptions made about personal injury law, but like many sweeping judgments many of these are wide of the mark. In this article we intend to debunk many of the popular myths which still surround this subject as well as helping you to find the best East Dunbartonshire no win no fee lawyers.

East Dunbartonshire no win no fee claims

There is an assumption that no win no fee claims make it much easier for people to claim compensation and that as such many have a go even if they don’t think the law will be on their side. In truth there is one big obstacle to this – and that’s the law firm. Although you don’t take on any risk, they do. If they don’t win the case they will not be paid despite spending a considerable amount in legal fees of their own. The risks become higher the more complicated the case. Not only will these last longer and therefore cost more, but they will also have a higher risk of failure. As such a law firm is unlikely to take on a claim if they don’t think there is a realistic chance of success.

    Will I have to pay?

This is another area of confusion and that’s thanks to constant changes to the system. Until 2013 it was possible for law firms to claim all their costs back from the other side when they won. This included the success fee which meant that as a claimant you would not have to pay a single penny no matter what happened. The insurance companies complained that this was not fair and suggested it might force them to bump up their premiums. This was enough to get the law changed which now means that if you make a personal injury claim which is successful you will have to pay something for the privilege. How much will depend on the individual lawyer so it’s always a good idea to find out what the payment structure is before you agree to use any law firm.

    Too many people claim

There is also a perception that far too many people are claiming compensation – which is linked to our first point. Again the statistics don’t bear this out. In fact according to a YouGov poll only around 20% of those people who could make a claim actually do so. That’s because they don’t know that they have a right to make any claim. The number is growing but that’s because people are becoming more aware of their rights.
