Damages claims may be made for any personal injury which you sustained in an accident that was no fault of yours, or for an illness you contracted which was caused by another person’s negligence. This might have been food poisoning or the bacterial infection MRSA, caused by a so-called superbug which has become resistant to antibiotics. You may also have been diagnosed with an occupational disease or work-related illness. You have to begin a personal injury compensation claim within three years of the date of your accident.

How do I make any damages claims?

First of all, you should contact an accident solicitor who has the experience and expertise in winning damages claims for your kind of accident and injury. An accident solicitor will generally be able to deal with any possible compensation claim you might have by phone, although you may need to attend a medical assessment to determine the nature and severity of your injury. Most claimants do not need to attend court.

If you have been severely incapacitated, you could arrange for your solicitor to meet you at your home or in the hospital. Although you have three years in which to file any damages claims, it is better to do this as soon as you can. This is because the details of the accident will still be very clear to you, and because if the case has to go to court then it could drag on for years rather than weeks or months.

Also, an accident solicitor can advise you to take or not to take any out-of-court settlement you may be offered. Sometimes, people involved in damages claims take the money that is first offered, and in some cases this is never enough to compensate for the pain, distress and suffering caused by the accident and resultant injury.
