    Claims in North Ayrshire

Personal Injury Solicitors in North Ayrshire

The personal injury claims in North Ayrshire that we here at Accident Advice Helpline assist people with cover a wide cross section of accidents and injuries. In terms of North Ayrshire’s local economy, it is made up of a mixture of industry, retail, farming and tourism; and this is represented in the types of accidents and injuries that we get involved with.

But whatever the nature of the accident and injury, in order to qualify for personal injury compensation, they all have to follow a certain pattern in terms of the circumstances in which they happened.

The circumstances that personal injury claims in North Ayrshire must comply with

The first circumstance is that the accident that leads to any injury must not be the fault of the injured person. If it is, that will probably nullify the chance of making a successful claim. The blame has to lie with someone else: The driver of another vehicle, an employer; a contractor who left something lying around that caused a trip and fall injury; a landlord who hadn’t maintained a property correctly – the list goes on.

The next important factor is that the injury victim must have received medical attention for his/her injury. This serves two functions. In the first place a medical treatment record substantiates the fact that the injury really did happen. In the second place it can be used to ascertain the severity of the injury, which may affect the size of the compensation award.

The last key point is that the incident/injury must have happened in the 3 years leading up to the date that the claim for personal injury compensation is registered. This is in order to comply with current legislation and the 3 year statute of limitations.

There are some exceptions to this rule, notably if the injury victim is a minor. In this instance the 3 year statute of limitations doesn’t start counting down until the injury victim’s 18th birthday. This covers the possibility of an injury victim’s parents or guardians not bothering to raise a claim for compensation while the victim is still technically a minor and leaves plenty of time (three years, in fact, after the victims 18th birthday), in which the victim can decide for him/herself whether or not to launch a claim.
