    The idea was to reduce the number of people making claims for marginal issues or minor injuries, but the effect was to close off the legal system to those who did not have the funds to press ahead with a full claim.

    We thought this was not fair which is why we created the Accident Advice Helpline back in the year 2000. The aim behind it was to make certain that if we could not help you win your case, we would not expect to be paid a single penny. Think of it as a form of reassurance which avoids the danger of being forced into financial difficulties as the result of a failed claim.

    For a while lawyers were allowed to claim their success fees from the other side. This was a good way of working because it meant that claimants could keep 100% of their compensation settlements which meant they had more money to go towards getting their life back on track. However the insurance companies objected to this again warning that it could force insurance premiums up. The government fell for this line and forbade lawyers from claiming their success fees from the opposition.

    So the question of how much those fees are is very important – even for people making Brighton and Hove no win no fee claims. Normally law firms should charge no more than 25% of any compensation arrangement, but some may seek to push that up a little – and a few will have hidden fees.
