Checking your eligibility to claim
You may not be aware that simply being involved in an accident is enough to justify the claiming of compensation. There are in fact certain criteria that need to be met in order for your claim to be valid. Generally speaking these fall in to three categories.
Firstly, your accident must have been the fault of someone else. This is vitally important because this is the person against whom you are going to make a claim and ultimately seek compensation from. If you are to blame for your accident then it is not going to be possible to make a claim.
Secondly, your accident must have left you with provable injuries. This is just as important because you need to be able to justify why compensation is being sought. It’s all very well saying you were injured, but you will need to be able to prove these injuries. This is best done through your medical records, therefore it is important that you sought medical attention as soon after your accident as possible.
Finally, your accident should have occurred within the last three years. This is because there are strict time limits involved with the making of a claim and this is usually three years. However, there may be situations in which this time limit can be extended. For example, if you were a minor at the time of the accident and therefore unable to make a claim you will have until three years after your 18th Birthday to start the process.
