    Clackmannanshire No Win No Fee

The last few years have been challenging for some personal injury law firms as the way in which people pay for their legal services has changed significantly. All these changes will have significant implications for anyone who is looking to make a claim which is why they are worth knowing about. In this article we’ll look at the ways in which we can help you make a claim and why, if you’re living in Clackmannanshire no win no fee can be easier to find than you might imagine.

Clackmannanshire no win no fee claims

Ever since legal aid was removed from the majority of personal injury claims we have been going down a long and winding road. First no win no fee was brought in to cover people in case they lost their case. This in turn created problems for law firms who faced the prospect of having a big hole blown in their finances if they didn’t win. Therefore the government laid down provisions that they could increase the level of their fees. This meant that people who won a case were in effect paying for those who did not. Because some feared that this then meant a raw deal for claimants they then allowed lawyers to claim all their fees – including success fees from the other side. This meant that people kept 100% of their compensation and that insurance firms had to collect the entire bill.

    Major changes

However the insurance firms were understandably not happy about this which is why they lobbied the government to get the rules changed back. In 2012 they were successful and the law was changed to prevent lawyers claiming their success fees from the defeated side. However, this meant that they would then have to claim their fees from their clients which in turn meant people were being under compensated. To adjust for that the amount which is awarded for most claims has been increased which puts things back onto an even keel.

    Making a claim

This has some difficult implications for law firms. They can choose to work only on their basic legal fees which can be recovered from the other side or they can pass this cost on to their clients. If they do the former they may struggle to make ends meet which in turn could affect the quality of service they are able to provide.

    Paying for a claim

It has therefore never been more important to make sure you understand what any law firm will be charging before you select them. Not only should you be looking at Clackmannanshire no win no fee lawyers, but also at what they charge if you do win.
