Apportioning the blame for your Bolton accident at work

If we believe that you may have contributed to your accident, it may be necessary for us to resolve your claim by agreeing liability on a split basis. For example, if you tripped down a flight of slippery stairs in your workplace, but did not have your shoelaces fastened at the time, we may have no other choice but to apportion the liability for your accident on a 50/50 basis.
If a split settlement is agreed, you would receive a proportion of your claim. For example, in the case of a 50/50 split, you would receive 50% of the compensation for your injuries and financial losses. If your employer offered you £5,000 subject to liability and you accepted this offer, you would therefore receive £2,500 in compensation (50% of the original amount).
While liability agreements are always described in terms of percentages, it is important to realise that they do not have to comprise a 50/50 split. If we were to agree on a 75/25 liability, you would receive 75% of the overall value of your Bolton accident at work claim, while if we were to agree on a 25/75, you would receive 25% of the overall value of your claim.
