Hull City Council has agreed to pay compensation to people who received injuries as a result of tripping over a sunken drain. Injury was caused to one five-year-old boy when he was walking to school, when he tripped on the drain, which was sunk into the pavement. He sustained a nasty injury to his head that left him with blood running down his face. He required a trip to Hull Royal Infirmary and the staff there glued the injury to stop the bleeding.
After the accident his mother, Candie Gilchrist, contacted the council to let them know what had happened and to report the condition of the drain. However despite her contacting them nothing was done about it. It was only five months later that she decided to seek legal advice about getting compensation for the sunken drain injury because she was worried the same thing could happen to someone else.
Even though compensation was paid by the council it still did not fix the drain and someone else has since suffered another injury and claimed compensation as well. The drain has now been repaired to prevent this from happening to someone else.
Is it possible to get compensation for an injury caused by a pothole?
The best way to determine if your injury should result in receiving compensation is to contact a professional injury compensation lawyer. Potential hazards can have the potential to cause accidents and if they are not repaired in a timely manner this could result in a claim for compensation for negligence. The compensation claim could depend on the situation and how severe an injury was. Potholes can be very dangerous on pavements as well as in roads, and as indicated here pedestrians can be injured quite easily.
