Small Claims Court

The outcome of a compensation claim

Attending a hearing at small claims court need not be a stressful or traumatic experience; in fact attendance is not required in many cases. For many involved parties an out of court settlement is the preferred way to end a claim rather than a lengthy and costly court case.

Of course where your case makes it to a claims court or is concluded by an out of court settlement there is still a legal process to be adhered to, so it makes sense to engage the services of a legal professional to help you, even if only in an advisory capacity.

Accident Advice Helpline has been established for over 15 years, and in that time has formed an extensive legal team. With friendly professional help close at hand, a simple phone call can be all that’s needed to kick-start your claim.

The Small Claims Court

The small claims court in its present form dates back to the 1970s where the princely sum of £75 was the upper limit for any claim. This increased to £1000 in 1991 and increased again in 1996 to £3,000. By the end of the 1990s the upper limit for claims had risen to £5,000. Throughout this period though, the judging body could take the discretionary decision that the value of a claim could exceed the current limit. The limit is yet again under review with discussions starting in 2011 aimed at setting a new limit of £15,000. As always though, the limit is intended for guidance only.
