    Product liability: Faulty seatbelts

    First developed by Volvo, seatbelts have become quite literally speaking, a lifesaver. Proper restraint in the event of a serious road traffic accident can make the difference between an injury and a fatality, and the importance of buckling up cannot be understated. However, despite rigorous safety standards, a seatbelt can sometimes still be faulty and it is important to know what remedies are available if you have a vehicle with a faulty seatbelt.     Seatbelt defects which may lead to a product liability claim can include a seatbelt unlatching upon impact, torn webbing in the fabric of the seatbelt, retractor failure, automatic belt systems which fail to respond automatically, and tension relieving devices that do not function properly. If one belted individual is injured as the result of a road traffic collision whilst others were not, this may be an indicating factor that that seatbelt was faulty.

    If the buckle of a seatbelt unlocks in the event of a car accident, this can be a particularly serious incident. This phenomenon is known as ‘false latching’ and describes when a buckle appears to be closed but is not. During the crash, this can mean that the people in the car can be thrown from the vehicle despite wearing a seatbelt. Unfortunately, this often has fatal consequences.
