A Freedom of Information request by the Barking and Dagenham Post has revealed the council is paying out £83 every day for compensation claims related to pothole trips. In fact, over the last six years, the council has spent £182,635 on claims relating to vehicle damage and personal injury from pothole trips.
Between January and May 2014, 22 compensation claims had already been lodged – compare this to figures for 2013, when 40 claims were lodged in the whole year, and it’s easy to see why local residents are concerned. Katie Reed, an 18 year old from Dagenham, tripped in a pothole just metres from home and twisted her ankle, leaving her unable to walk for days. In 2009, a similar incident led to someone being awarded £29,322.82 after a pothole trip, and earlier in 2014, a cyclist who hit a pothole was awarded £44,234.
It seems the area’s roads are getting worse, and local residents are having their say. Natalie Abbott, a local mum, commented, “My daughter suffered an injury a few years ago on the pavement in Marks Gate. She had to go to hospital and had her ankle in plaster for two weeks. Lucky it wasn’t broken, just twisted. Even now she has trouble with it.”
Claiming compensation for slips and trips
Your local council has a duty to maintain roads and pavements in your area to a safe standard, so if you’ve been injured after tripping in a pothole or on a cracked pavement, you could claim compensation. Failure to properly maintain road surfaces is negligent behaviour and could lead to serious injury. Broken bones, cuts and bruises, concussion and even fatalities can be caused by poorly maintained roads and pavements. If you have been affected, contact a personal injury lawyer to see if you are eligible to make a claim for compensation.
