The term ‘no claim no fee’ is a term similar in meaning to ‘no win no fee’
This term ‘no claim no fee’ is a colloquial and marketing reference to the legal term Conditional Fee Agreement (CFA). CFAs came to life around 1995 when the legal aid system for personal injury cases was ended.
This meant that people no longer had to be ‘means tested’ to access legal aid. This has leveled the playing field so that everyone, no matter what their personal financial circumstances, can make a compensation claim for personal injury.
BUT not all legal practices work on a ‘no claim no fee’ basis!
What exactly does it mean?
No claim no fees solicitors work on the basis that if they do not win your compensation case, they will not charge you for their work. This, of course, has an added advantage to you in that a solicitor does not like working for free, therefore if they are not confident that can win your case, they will be honest with you and tell you this.
You can still engage them to take on your case, but you need to think about this carefully. If you go on to lose your case, you may be liable to pay the bill of the opposing side as well as your won.
