    How does an NHS claim work?


    At Accident Advice Helpline, we deal with medical negligence claims on a regular basis and are happy to advise on how an NHS claim works. You can call us at any time of day or night, any day of the week, and we will be happy to go over your personal situation with you. Claims of this sort can be complicated and can take some time to process, but the sooner you understand what your options are, the easier it is for you to take effective action.

    When can I claim?

    If you have been the victim of medical negligence, you can make a claim for compensation at any time within the next three years. Medical negligence is any situation in which you are treated incorrectly, or not given treatment that you should receive, by a qualified medical professional. It applies to doctors, surgeons, nurses, dentists and so on. It might cause immediate injury, or it might result in a problem developing more slowly, in which case you will need another doctor to confirm what has happened and why.

    There are several different methods for lodging complaints about poor NHS treatment and your GP can advise you on where to begin. There is no internal compensation system, however, and if you have been left with serious difficulties because of what happened to you, receiving compensation may be important in letting you get on with your life. In this respect, an NHS claim works in the same way as any other; you will need a solicitor who can collect evidence and move the case forward for you.

    Finding a solicitor

    It can be difficult to know where to begin with the process of finding a solicitor. Many people simply look in the phone book, but if you visit a local solicitor you may have to wait a long time before they can take on your case, they will probably want to be paid weekly, and it’s unlikely that they will have specialist expertise.
