What can I claim for an MRSA infection?

If you can prove that the MRSA infection wasn’t your fault, if it happened in the last three years and if it required medical attention afterwards, then you may well be entitled to compensation. MRSA is a type of bacterial infection that is resistant to some of the best known, widely used antibiotics. This makes MRSA hard to treat, which may have impacted on your life in a particularly negative way. MRSA is meticillin-resistant staphylococcus aureus; it is popularly known as the ‘superbug’.

    How do you get MRSA?

MRSA can be more easily caught in hospital. This is because hospital patients can have open wounds, which the bacteria find easier to penetrate, or because hospitals are busy places, in which bacteria is easily spread. Older and sick people can be relatively weaker and so more prone to infection. MRSA can often be prevented by rigorous hygiene standards.

I was infected by MRSA – what can I do?

MRSA can be caught easily if standards of hygiene are poor, although hospitals have a strong duty of care towards their patients and visitors. It does not matter whether you were being treated in hospital at the time of your infection, or if you were visiting friends or family. If you were infected by MRSA and the cause can be shown to be negligence on the part of those running the hospital, you could claim for compensation.

I don’t feel right claiming compensation from a hospital

Hospitals are there to help others in their moments of greatest need. They also have a duty of care for their visitors. There are strict laws and regulations that cover how hospitals should be run, including how clean they should be. MRSA infections are often caused by poor standards of hygiene. If you have caught an MRSA infection, and it wasn’t your fault, you are entitled to seek compensation for it. Also, consider the fact you may help prevent poor standards of hygiene from continuing in hospitals. You may be doing a lot of people a big favour by highlighting an issue some are too scared to speak up about.
