How much can you get in compensation from an injury?


There is no definitive answer to the question, ‘How much can you get in compensation from an injury?’ However, there are guidelines which a solicitor can refer to which can give a ballpark figure of how much you could get for an injury or illness. You can claim personal injury compensation for an injury sustained in an accident that was not your fault if you file the claim within three years of the date of the accident.


How much can you get in compensation from an injury?

Let’s take a look at some of the figures from the Judicial Studies Board which issues guidelines for the amount of compensation to be awarded to those who have suffered an illness (such as a work-related one or an occupational disease, or one brought about by another person’s negligence, such as food poisoning) or an injury.

How much can you get in compensation from an injury to your back, which you sustained in an accident that was not your fault? For a severe back injury, you could get between £21,500 and £93,000. For one that is deemed moderate you could get between £6,750 and £21,500. If you sustain only a minor back injury you would get up to £7,500. However, that is only for the injury.

Compensation covers loss of earnings for the period you were unable to work, and if the injury were severe, it will also cover future loss of earnings. You can also claim for medical expenses and treatment which you can’t get on the NHS, perhaps acupuncture for pain relief or physiotherapy, for example, as long as you keep receipts.


Industrial diseases

How much can you get in compensation from an injury or illness such as industrial deafness? There are guidelines for industrial diseases too and for total deafness, you could expect to be awarded between £50,000 and £60,000. For total deafness in only one ear, the sum you could receive in compensation would be between £17,500 and £25,000.

How much can you get in compensation from an injury to your wrist? The answer to this is that the maximum amount you could receive is £33,000. The amounts can be found in the “Judicial Studies Guidelines.”
