    Cosmetic surgery gone wrong — can I claim?

    These days, more and more people are benefiting from successful cosmetic surgery, but the down side of this is that we at Accident Advice Helpline encounter an increasing number of cases of cosmetic surgery gone wrong. It’s certainly possible to claim for this, though individual cases differ.  If you have a valid claim, we can help you to pursue it successfully.

    When is a claim valid?

    A medical compensation claim can only be made when the problems suffered by the patient have not been caused by standard risks of the procedure which they understood beforehand. If a surgeon has done something wrong or neglected to do something important, you could have a claim. If the risks were not properly explained to you before the surgery took place (e.g. if you did not sign a document saying you understood and accepted them), you could have a claim. You cannot bring a claim if you were just unlucky.

    In order for a claim to be allowed it normally has to be brought no more than three years after the surgery takes place. There can be exceptions if problems directly attributable to the surgery show up later, as has been the case with some substandard breast implants. If you’re not sure about the validity of your claim, you can give our advisors a call at any time of day or night. They’re used to dealing with similar cases and will usually be able to tell you if your claim is worth pursuing. They may also be able to help you work out how much compensation you would be likely to get.

    Although other aspects of medical negligence compensation claims can be complicated, the payout is usually quite simple. You will be entitled to money to cover the costs of any further treatment you have needed because of the cosmetic surgery gone wrong. This could include the cost of further surgery designed to restore your appearance. You will also be entitled to compensation for your pain and suffering, including any ongoing problems you may have. This can cover things like stress as well as pain and disability. Last but not least, you can expect compensation for any lost earnings caused by having to take time off work or losing your earning power due to the problems caused by the surgery.
