Compensation for tripping on a pothole

When we hear about potholes in the road we tend to relate them to accidents involving cars or other vehicles. Our first thought is not how dangerous they can be for pedestrians and yet people walking around their neighbourhood (or anywhere else) can find it just as dangerous to encounter a pothole as drivers can.

The local council is responsible for maintaining the safety of the roads in their area. This holds true across the country. If someone ends up tripping on a pothole they have as much right to claim for compensation as someone who hits one while driving over it in their car. The injuries for a pedestrian can be worse because putting your foot in a hole when you’re not expecting one to be there can lead to some nasty accidents. There is the potential to fall in the road if you are crossing and this is obviously extremely dangerous if other road users don’t see you. It pays to be alert when walking around but you cannot always see every pothole and since they should not be there anyway it is worth making sure you keep an eye out for them to minimise the chances of being affected.

Can pedestrians really claim for compensation for tripping on a pothole?

Yes – if you can prove negligence on the part of the council involved, you have an opportunity to claim for compensation for any injuries you may have sustained in the accident itself. Twisted ankles, broken bones and cuts and scrapes are very common but sometimes people can be unable to break their fall, incurring even more injuries and facial damage in some cases. Needless to say this is painful and it can take some weeks (or longer, in some cases) to recover.
