Claiming compensation for a bungled operation

What would your reaction be if you found out you had to have an operation? Any type of surgery is nerve-wracking to have, even if it is fairly minor or a common-enough procedure. Regardless of what you are having done and how long it will take to recover, you do tend to assume everything will work out fine in the end.

However there are some people who have undergone operations where something has gone wrong at some stage. This can be very different from a situation where something happens that could not reasonably have been foreseen. While it is very rare for something to occur that hasn’t been accounted for, or for a medic to make the wrong decision or not perform their job properly in some way, there is a potential for something like this to happen. Thankfully we rarely read about things like this because for all the thousands of operations that take place each day, most of them go without any hitches or problems at all.

In cases where a bungled operation does occur, you do have a right to find out what happened and how things went wrong.

Is it right to consider claiming compensation for a bungled operation?

If you were ever to find yourself in a situation where this could reasonably have happened then yes, it is absolutely right to consider making such a claim. Of course you should seek legal advice prior to taking any other steps in this direction. However there is a three-year window in place that gives you this amount of time in which to make the crucial decision on whether to pursue a claim or not. As such it is worth thinking about it if you have been through something like this.
