Is my claim void if I can’t get witnesses?

The more evidence you have to back up an accident compensation claim, the better, but if you can’t get witnesses, that’s no reason to despair. Sometimes accidents happen when you’re all alone and sometimes you’re so shaken immediately afterwards that you don’t manage to get anyone’s details. There is no legal obligation for you to have witnesses in order to pursue a claim. Here at Accident Advice Helpline we can help you to build up your case in other ways.

Swift help if you don’t have any witnesses

Our lines are open 24 hours a day, seven days a week, so we’re always ready to help when you’re ready to act. If you don’t have witnesses it’s best to act as soon as possible. Although you can legally make a claim any time in the first three years after your accident, acting sooner means you’re more likely to be able to assemble the alternative evidence necessary to claim successfully.

Working with a solicitor

If you choose to pursue a claim, we’ll put you in touch with a solicitor within the right area of expertise to maximise your chances of success. Because we’re a national organisation, we have access to the best available talent and you won’t have to wait in a queue for somebody to be available. You’ll normally be able to work with your solicitor over the phone, so you won’t need to keep travelling around for meetings.

Once you have a solicitor, they will be able to help you in strengthening your case. For instance, they may be able to find out if there is CCTV footage that shows your accident and they may be able to track down witnesses you were not able to find by yourself.

Things you can do to help your case

If you want to make sure you have a strong case before taking further action, you can begin by taking photos of the area where the accident happened. It’s useful to do this from several different angles. You can also take photos of your injuries. You will need to have seen a doctor so that medical confirmation of those injuries can be provided, but pictures can still help by showing how you were at your worst.

Sometimes even traumatic events can fade in the memory over time, so it’s also useful to make notes as early in the process as possible about how the accident happened. These can help to fill in any detail needed later if there is nobody else available to ask.
