    Is there a car accident claim time limit?


    While some of those who find themselves caught up in a car accident end up going on to make compensation claims, this is usually far from being the first thing those individuals think of at the time of the accident. If evasive action is not necessary – sometimes there’s simply not enough time for that – the collision occurs and the person is left with injuries that could incur a lot of pain. It is only later on that they might wonder whether there is a car accident claim time limit.

    In most cases, the time limit in place is three years. This gives you plenty of time to get over the accident, to start to recover or make a full recovery, and to consider the possibility of claiming. Most people who do claim start the process much sooner, but it’s good to know there is time.

    Are there any situations where another time limit might be in place?

    The one exception is with children who experience injuries in a car accident. In this case, the three-year limit applies from the time the child turns 18. So if you were in a car accident and your eight-year-old child was in their car seat, they would have until three years after their 18th birthday to make a claim relating to their injuries.

    Essentially, this means whatever age your child is when the accident occurs, you don’t have to lodge a claim until before they reach their 21st birthday. Of course, many people will lodge claims far sooner, especially as it means they can complete the process and move on with their lives.
