Business in Forfar is fined after worker is crushed by a steel frame

Forfar Galvanisers has received a fine in court after an incident in which a worker at the premises in Carseview Road was crushed by a steel frame. The accident occurred on 20th November 2013 when Robert Ramsay, a 19-year-old agency worker, was helping with an A-frame at the premises. The A-frame was on a forklift at the time, but it slipped and fell on Mr Ramsay.

The incident led to a Health and Safety Executive (HSE) investigation, which in turn led to the court case. Our team here at Accident Advice Helpline have come across many other cases in which an individual has been injured at work in circumstances that could easily have been avoided.

A fine of £7,000 was given

The firm received a fine of £7,000, which due to their early plea had been reduced from £10,000. They could have faced a fine of £20,000 at most for the incident. The case was heard at the Forfar Sheriff Court.

In this case, the injured man was hit and crushed by a steel frame weighing nearly half a tonne. As a consequence of the instability of the frame while it was being moved, it slipped and hit Mr Ramsay. This resulted in bruised bones, external bruising, damage to muscles and tissues and severe swelling. In cases like this, where negligence of some kind can be proven, a compensation claim via a no win no fee* case could have a successful outcome.

An internal investigation was also conducted

While the HSE conducted an investigation, the business involved launched its own investigation into what happened. An external auditor has also been appointed since the accident to ensure that nothing like this happens again, and that the site remains as safe as possible at all times.
