    True or false? I can’t receive compensation as my road traffic accident might have been my fault


    In all adverts you see for road traffic accident compensation claims they say if you have had an accident that wasn’t your fault you could make a claim. However, what happens if you aren’t sure if it was your fault or not?

    Could I still be eligible to make a road traffic accident claim in this situation?

    You may possibly be able to make a claim. The claims company together with the police reports and any witness statements will help to find out whether it is more likely the road traffic accident was your or the other driver’s fault. They will fully investigate the matter and a decision will be made based on the information they have as to whether or not you can make a car collision claim.

    What if I feel strongly it wasn’t my fault but the court is finding in favour of the other driver?

    If you feel that the verdict they give is not right then you can appeal against this where the courts will look into this again and decide whether they will award you compensation for your road traffic accident or not. This can be a lengthy process but if you feel that the car collision was definitely not your fault the compensation could make it worthwhile.

    Can I still get driver injury compensation if it was my fault?

    It is very unlikely you would be awarded any road traffic accident compensation if it was your fault unless there was a mechanical fault with your car which meant you could not have prevented the accident. In this case, the manufacturer of the car may be liable for driver injury compensation for this.
