Package travel, holidays and tours are essentially holidays or tours for which at least two of the components below have been pre-arranged:
- Other tourist services accounting for significant proportions of a package, but not ancillary to accommodation or transport
Including a fairly wide range of arrangements, from completely pre-defined packages to tailor-made holidays with several pre-selected components, package holidays are subject to strict regulation.
These regulations state that holidays must be as described in the brochure and that none of the pre-travel information provided should be in any way misleading.
When things go wrong
Any deviation from or alteration to a booked package holiday or tour (before or after travel) may give the disappointed holidaymaker the right to claim for travel compensation.
Compensation claims may. for instance, be made for:
- Loss of value: if there is a difference of value between the paid-for holiday and the one actually received
- Expenses: reasonable expenses that were incurred as a direct result of a breach of contract
- Lost of enjoyment: remuneration for distress and disappointment caused by things not being as they should be or going wrong
The fourth and final possible claim in terms of package holiday is a claim for personal injury compensation.
Such claims may be made, for example, after suffering injuries by slips, trips and falls during a holiday. In order to claim for slip, trip or fall injury compensation, the injury by slipping, falling or tripping must have been the result of someone else’s negligence, mistake or inappropriate behaviour. The trip, slip or fall injury must also have been sustained within the past three years.
