    How long will it take to settle a personal injury claim?

    I’m looking to settle a personal injury claim, how long is it likely to take?

    The length of time needed to settle a personal injury claim depends on a number of factors. When it comes to personal injury claims, there are two key factors that need to be established. They are:

    • Liability: Who is at fault for the accident occurring
    • Medical evidence: Proof from a medical professional that the subsequent injuries were caused by the accident and the extent of their damage.

    In most cases, personal injury claims need to be started within three years of the accident taking place. There are a few exceptions to this rule, notably:

    • Industrial ill health: Complications caused in later life as a result of, for example, working with asbestos in previous years.
    • The accident victim was under age at the time of the incident.

    For the claim process itself, it can be very difficult to predict a length of time for it to take. In the most straightforward cases – where liability is quickly established and not argued and the medical diagnosis is straightforward – it may only be a few months.

    However, injuries such as those arising from road traffic accidents tend to be serious, with lengthy recovery and rehabilitation times. This means it may well be months before the extent and impact of your injuries are known. Attempting to settle before this is established runs the risk of missing out on the full value of the compensation you deserve.

    Then there’s the issue of liability. If the other party refuses to accept responsibility, or argues over where the blame lies, then the process will take longer.
