"If you've been injured through no fault of your own you could be entitled to compensation. If you're unsure if you could claim, I recommend you call Accident Advice Helpline."

    Esther Rantzen

Is there ever a standard amount of compensation?

There are so many different types of compensation claims possible that there is no one standard amount of compensation for each one. However, if we look into just one type of claim such as from a road traffic accident then there are often standard amounts for certain claims.

How does standard amounts of compensation come into a car crash claim?

One of the most common car crash claims is for driver injuries. With personal injury claims there is usually a set limit which has been decided upon by the courts. This amount is usually awarded in standard road traffic accident cases but not for all claims. There may be some exceptions made which means that more compensation is awarded for a certain driver injury.

When would an exception be made for a driver injury claim?

If the driver has been seriously hurt to the point that it has caused significant financial loss, physical or emotional pain or suffering. As well as this, exceptions may be made when the driver injury is ongoing and is something that will likely affect him or her for a long time. This could be anything from recurring pain from damaged limbs to mental health conditions worsened or that occurred partly due to the car crash.

Alternatively, if the driver injuries were maliciously or purposely caused then the standard amount may be increased.
