    Defining no-win no-fee*: What does it mean?

    You have probably heard it a lot, particularly if you have researched compensation claims but what exactly does ‘no-win no-fee**’ mean?

    Defining no-win no-fee**

    Accident Advice Helpline works on a no-win no-fee** basis, over all of our compensation claim cases, whether it is for a road traffic accident, accident at work, slip, trip or fall, or any other type of accident that leads to injury.

    In the UK, no-win no-fee** refers to a conditional fee agreement between a claimant and a law firm such as Accident Advice Helpline. This means that the law firm takes on the case but if it is lost then the claimant does not have to pay. If you win your compensation case, however, then the basis of the fee is, usually, the normal hourly billing rates plus a success fee.

    These types of fees were originally made available in 1995 and amended most recently in April 2013 so that injury lawyers no longer take their success fees from the losing party. Following a successful claim a percentage of the compensation awarded is used as the lawyer’s fee; this is currently limited to a maximum of 25 per cent.

    No-win no-fee** in Scotland

    In Scotland things are a little different as rather than fixing a percentage of the winnings as the amount of fee paid the client and lawyer agree on a per cent increase in the fee on winning the case.

    • Your injury must have been the result of an accident in the last three years
    • It must have been somebody else’s fault
    • It is helpful to have witness information
    • Organise all the documents and facts you have at your disposal
