Can you claim if you were a passenger in a car accident?

We are often asked whether it is possible for passengers hurt in motoring accidents to claim for compensation. The answer to this question is simple. If you were injured as a passenger in a car accident, you can make a passenger injury compensation claim to cover your losses and injuries.

Hurt as a passenger in a car accident

Passenger injuries can range from minor scrapes, bruises or whiplash to life-changing, even fatal, head and spinal injuries. In addition to physical pain and suffering, such injuries may also cause serious psychological and emotional problems and financial hardship. Passenger injury compensation will take all these factors into consideration.

    Other incidents

In addition to claiming as a passenger in a car accident, you can also make a claim if you were injured as a passenger in a taxi, bus, train or plane. Either way, you would claim against the individual or authority responsible for causing your accident.

    Who was to blame?

This means it is essential to determine who was responsible for the accident that caused your personal injury. This could, for instance, be:

    • The driver or pilot of the vehicle you were in
    • Another road user (in case of car, taxi or bus accidents)
    • A person who caused a train accident or plane crash in some way
    • The person or authority responsible for the maintenance of the vehicle
    • The authority responsible for the maintenance of signals, etc.

If a road accident was caused by a defect in a new vehicle, for example, the manufacturer or retailer of the vehicle may also be held liable.
