    Can I make a military claim if my accident occurred at war?

    Serving in the military is a noble, exhilarating, but dangerous occupation. On top of the obvious dangers of engaging in combat, soldiers and other members of the armed forces are subject to the same risk of accidents at work as anyone else.

    Can I pursue a claim for compensation against the military?

    Until 1987 the Ministry of Defence was immune from all personal injury claims due to the Crown Proceedings Act 1947, which provided the crown with immunity from suit. It is now possible to pursue a work-related military claim for compensation if you’ve been injured during service in the armed forces.

    But what happens if your accident occurred at war?

    The military is subject to the same stringent health & safety regulations as any other employer. This means that the military must:

    • Provide all service personnel with the correct equipment to help them complete their job and ensure that the equipment is maintained and safe to work with
    • Ensure that a safe and tidy work environment is maintained
    • Provide proper training for those who are required to lift heavy objects
    • Ensure that service personnel are provided with the correct safety clothing to complete their job. This includes safety gloves, dust masks, hard hats and eye protectors

    If you’ve suffered an injury or become ill as the result of not being provided the correct equipment, you could be entitled to make a claim for compensation, even if the accident occurred at war.
