    Around two thirds of aggrieved cyclists do not take legal action

    Around two thirds of aggrieved cyclists do not take legal action despite the fact that they could potentially make a compensation claim according to a new survey. The survey has shown that over 35% of the 300 cyclists asked have been victims of a pothole causing their bicycle to swerve off-course or have been victims of driver errors on the road. However, only 11% took legal action to address the issue which could have caused them to be in a serious accident or sustain injury. The survey contradicts the recent views that the UK is adopting a claims culture and indicates that many people are still reluctant to take legal action, even when they could be entitled to compensation.

    Some of the cyclists asked viewed did sustain injuries as a result of negligence on the part of someone else, yet they did not choose to claim the compensation they were entitled to. Motorists were the main concern among cyclists and 75% of respondents stated that they were most fearful of their safety around motorists. Only 20% were worried for their safety when cycling on poorly maintained roads. A separate survey showed that 10% of motorists had experienced a collision with a cyclist, with 4% accepting their own guilt over the incident and 6% blaming the cyclist.

    Road accident compensation

    Cyclists are among the most vulnerable road users therefore the risks of serious injury are higher when travelling by bike. Although many motorists are wary of their surroundings and are respectful of other road users, many road users can put lives in danger with their reckless behaviour. Many of the aggrieved cyclists in this survey did not pursue compensation even though they could have been entitled to it.
