Accident whilst on holiday

When you go on holiday, you imagine yourself walking in the sunshine and generally relaxing. You might have been saving all year for a dream trip to the Caribbean or be holidaying on a budget in the South of Spain – it doesn’t matter as a holiday is always special, no matter where you go. The last thing on anybody’s mind on holiday is being injured in an accident, but unfortunately accidents abroad can and do happen. An accident whilst on holiday can be stressful, especially as you will be away from home, in a foreign country and possibly surrounded by people who don’t speak your language.

Planning ahead can go a long way towards staying safe whilst on holiday. Having accommodation organised before you arrive means you can ensure you have a good place to stay, and you can choose a hotel which will do its best to keep you safe.

Holiday accidents

No matter where you are injured, it can be very stressful, and while the types of accidents that could occur whilst on holiday are very similar to those that can occur when you are at home, you have the added disappointment that you won’t enjoy your time away and that you have wasted money on a holiday which has now been ruined. You could find you’re eligible to make a claim for personal injury compensation if you have an accident on holiday, but it all depends on how you booked your trip. If you have booked a package deal through a UK tour operator then you could make a claim if you are injured abroad.

However, if you booked your flight and hotel separately, it’s generally not possible to make a claim. This is because UK tour operators take responsibility for you when you’re abroad – you are staying in a hotel that is in their portfolio and taking part in excursions which they have organised and are responsible for.

Hotels can have several floors and if you have a balcony, you have danger. Injuries incurred while you are on holiday can sometimes mean a painful or uncomfortable journey back home too. You could be injured after a slip or trip on uneven flooring in your hotel or by the hotel pool. Your children could be injured in an accident in the pool. Or you could suffer food poisoning after dining at the hotel during your holiday, and be confined to your room for the rest of your break. In all these cases, somebody else could be held liable – usually hotel management or your tour operator – for your accident, and you could have a viable claim for personal injury compensation.

If you have been seriously injured then you may need to undergo treatment in a hospital abroad. You will hopefully have travel insurance in place which will cover the cost of your treatment, but even if you pay for treatment out of your own pocket, you should be able to include these costs as part of your personal injury claim.
