Who we've helped - an AAH success story
"On the day of the accident I was staying in a hotel on the north-west coast. When I turned the dial to start my morning shower some cold water dribbled out for two minutes, and nothing more happened.
Just as I was getting fed up and was about to abandon my attempt, a jet of scalding hot water shot out without warning at full pressure and blasted me in the chest, leaving me with large blisters.
I reported the matter to the owner the following day but I do not know whether or not he recorded my mishap in the accident book.
He informed me that the hotel’s boiler had just been replaced, and promised that he would call the engineer to look at it.
I have since been to see my GP who warned me that I might require a skin graft.
I hold the defendant liable for failing to provide a safe environment, and made a personal injury claim through Accident Advice Helpline. I was awarded £2000."
Mr L, Cheshire
Claiming compensation after an accident
The vast majority of people who are hurt will not make an injury claim. Even when they are not at fault and could well be entitled to claim compensation, 70% of people do not. Injury compensation is something that has become more prominent in recent years, mainly since the concept of no-win, no-fee or the Conditional Fee Agreement was implemented in 1999 to replace legal aid (for personal injury claimants, at least).
The purpose of injury compensation
Generally, compensation in any legal action exists to serve three purposes. Firstly, it seeks to redress the financial balance that may have been disturbed when an injury victim has been forced to take time off work because of incapacity. Secondly, it is a punitive measure to punish the defendant: they have directly or indirectly caused the injury of the claimant and their obligation to pay them damages is a means of them making an apology for their action (or inaction). Thirdly, compensation, as the name suggests, tries to compensate the victim for any pain and suffering that they may have experienced.
Accidents at work and work injury
Accidents at work are a slightly different beast than accidents elsewhere: at home, you people are responsible for own safety, by and large. However, when at work, they are under the auspices of their employer. This means that they are responsible for making sure that all staff are safe at all times. The more dangerous the industry, the more precautions an employer will have to take. Work injury occurs all the time, unfortunately, which is why injured employees should consider making a work accident claim. If their injuries are so severe that they have been forced to take time off, a successful award of compensation may help them to meet the cost of living for the period of time when they are not receiving wages.
Car crash claims and road accident compensation
The most common type of injury claim arises as the result of a road accident. With so many vehicles on the road in the UK today, it is an unfortunate fact that accidents are unavoidable. If a motorist or a passenger is injured because of another’s negligence, then they may wish to make a car crash claim. The most frequent type of such a claim is for whiplash, caused when a vehicle is rear-shunted by another and the heads of those in the first vehicle are snapped backwards and forwards with great force. The symptoms of whiplash can include neck pains, headaches, nausea and pins and needles in the finger s and toes. It can lead to extended periods of time off work.
