Vineyard owner suffers fatal work injury

A delivery company has been fined and left itself open to the possibility of a claim for work injury compensation after they contributed to the death of a vineyard owner.

George Musgrave, the owner of Polmassick Vineyard near St Austell in Cornwall was helping to unload a consignment or empty wine bottles in April 2008 when the pallet containing them fell from the tail lift of the lorry and struck him, causing fatal head and chest injuries.

The delivery company, Gregory Distribution Ltd were fined £200,000 and ordered to pay £17,000 costs after they were found to have breached health and safety law.

Mr Musgrave’s family may also be entitled to bring a work injury claim on his behalf.
