Michelle Danicek hit her head on the floor of a nightclub in Vancouver in April 2001, after a drunken colleague overbalanced and knocked into her.
Her claim for work injury compensation was only concluded on Monday. She alleged that her head injury, which led to minor brain damage, nausea and difficulty concentrating, was partly the responsibility of the colleague who knocked into her and partly the fault of her employers, law firm Alexander Holburn Beaudin and Lang. She was awarded millions of dollars' worth of damages for loss of earnings, since she was a promising young lawyer with many years ahead of her, for which her colleague is liable. A second trial in November will conclude if the employer is liable for the actions of colleagues at post-dinner parties.
