How to make a Compensation Claim

How evidence is key to your claim

If you have been injured at work, in a public place or involved in a car accident, there are a few steps you can take in order to help maximize your potential for compensation by gathering evidence:
  • Take photos of the injury straight away to help prove the value of your claim.
  • Obtain the name, address and telephone number of all those involved and any police officer's name and number.
  • Take pictures of the scene and the surrounding area from all angles as soon as possible.
  • Take the name, address and telephone number of any potential witness. Don’t contact or speak to them, this should be dealt with by your solicitor.
  • After taking photos of any damage to property obtain at least two repair estimates and thereafter you should be able to arrange for repairs and be able to reclaim the cost.

Time limitation period and how if affects your claim

If you have had an accident you must start legal proceedings within 3 years of the accident. Failure to do this could result in the claim being disqualified. This means you will lose the right to claim compensation. The law about ‘limitation periods’ is complex and it is important that advice on compensation and the rules governing time limits be obtained from an expert as soon as possible after the accident.

Exceptions to the claim time limitation rule

There are certain exceptions to the 3-year rule:
  • If you were under 18 when the accident happened then the 3-year period only starts to run from your 18th birthday.
  • If the injury was not obvious at the time of the accident then the 3 years may start to run from when you found out about it, called the date of knowledge.
Under certain circumstances the court can extend the time limits at its discretion.
