Have you been injured in an accident in the workplace that was not your fault? Workplace accidents can be split into two categories. Firstly, you have incidents whereby injuries occur straight away because of an incident, such as a construction accident or an accident that has happened because of poor health and safety. Secondly, you have injuries that develop over time, such as industrial deafness or repetitive strain injury. In such instances, you can often find yourself making a claim against an employer you no longer work for.

Workplace claims in Redcar and Cleveland

Firstly, it is imperative to establish that there is a time limit on all workplace claims in Redcar and Cleveland. This is three years, which means you have three years from the date of the accident to make a claim and court proceedings must be issued in this time frame. Thus, if you were involved in a construction accident on 7th May 2013, you will have until 6th May 2016 to make a claim. If your injuries have developed over time, you will be unable to pinpoint an accident date and thus you will have three years from the date of your diagnosis instead.

A lot of people worry about making a claim against their employer, as they fear there could be repercussions. This is something you do not need to worry about. If your employer is responsible for your injuries, they will recognise that you need to be compensated and they will have an insurance policy in place to cover this.

If they were to fire you, they would only land themselves in further trouble, as you would then have grounds for unfair dismissal. You do need to make sure you handle everything correctly though and this means reporting the incident to your employer as soon as possible, as he or she will need to record it in the accident book, which they are required to have by law.
