The last key point is that the incident/injury must have happened in the 3 years leading up to the date that the claim for personal injury compensation is registered. This is in order to comply with current legislation and the 3 year statute of limitations.

There are some exceptions to this rule, notably if the injury victim is a minor. In this instance the 3 year statute of limitations doesn’t start counting down until the injury victim’s 18th birthday. This covers the possibility of an injury victim’s parents or guardians not bothering to raise a claim for compensation while the victim is still technically a minor and leaves plenty of time (three years, in fact, after the victims 18th birthday), in which the victim can decide for him/herself whether or not to launch a claim.
